E-Reg Monitor Service

In today’s regulatory environment, pharmaceutical, distribution and healthcare companies are faced with constant changes in federal and state legislation and regulations that affect everyday business. Although no common governance exists among the states, the states do maintain similarities in the way they define and regulate key areas of pharmaceutical marketing practices as well as licensing and distribution activities. To better understand the impact of these state-by-state regulations, BuzzeoPDMA’s E-Reg Monitor Service offers two surveys to assist the industry in monitoring these

AVDA members who subscribe to the E-Reg Monitor Service have access to an online tool that provides legislative and regulatory updates on Drug Distribution and Drug Pedigree laws on the Federal level and in all 50 states and the District of Columbia. Subscribing members have 24/7 access to the service and receive e-mail notification when updates are available. The annual subscription fee for AVDA members is now $2,500 per AVDA Member Company. Companies subscribing to this service would individually pay in excess of $25,000 per year.

If you already subscribe to E-Reg Monitor Service, you should have received a separate invoice with your dues invoice to renew your subscription.

Please contact Casey Joseph if you have not received your invoice or would like to subscribe.

LEGAL UPDATE

Costco v. Johnson & Johnson Vision Care, Inc.

On November 4, 2015 the federal district court denied JJVC's motion to dismiss with respect to five of the six claims filed by Costco granting the motion only with respect to allegations under New York Business Law and Breach of Contract.

Since that time, the Direct Purchaser Plaintiffs filed a consolidated class action complaint against a group of Manufacturer Defendants (Alcon Laboratories, Inc., Jolu1son & Jolu1son Vision Care, Inc., Bausch & Lomb, Inc., and Cooper Vision Care, Inc.) and four Retailer Defendants (Sam's West, Inc., Costco Wholesale Corp., 1-800- Contacts.com, and LensDiscounters.com). It is alleged that the Manufacturer Defendants conspired with each other and with ABB Optical Group, LLC, a wholesaler, as well as Eye Care Professionals and the American Optometric Association to impose minimum retail price 01' resale price maintenance policies on certain contact lens lines, eliminating price discounting and thereby eliminating price competition.
